Confessions of the Ex-‘Revo’: Befekadu Hailu

They are still indignant, confident and with unwavering devotion for human rights and the rule of law; the usual suspects, the one and the only ones- Zone9bloggers from the notorious Ethiopian prison still pen, criticize and inspire thousands regardless of the hardship they have to go through on a daily basis. I still couldn't believe this piece was written by someone who is being incarcerated for the crimes he didn't commit. Befqadu and his colleagues are critiquing the brutal and vengeful regime knowing that their shackles on their skinny arms and legs will be fastened harsh for such writings. I think, we are the ones who are in jail; THEY- the unbeatable young, fearless and innocent Ethiopians are sacrificing their lives to free us, AMEN!      

There was a time in my life when I used to think a lot about revolution in Ethiopia. In fact, in 2011 during the so called ‘Arab Spring’ I wrote a rejoinder article when Ethiopian democracy activists (especially those who are based in diaspora) planned a ‘Day of Rage’ using

ወይ ጥንካሬ፡ ወይ ብስለት፡ ወይ የዓላማ ጽናት እንጂ ሌላ ምንም ሊባል አይችልም፡ይህንን የበፍቄን በሳል እና ትንተና የተሞላበት ደብዳቤ ለሚያነብ ሰው፡ በርግጥ፡ አንድ፡ ባልሰራው ወንጀል ቁምስቅሉን ከሚያይ እስረኛ የተጻፈ ነው ብሎ ለማመን እጅግ ይከብዳል። ዛሬም ይጽፋሉ፡ ይተቻሉ ያላንዳች ፍራቻ፡ ምንም እንኳን እንዲህ ዓይነቱ አልበገር ባይነት ተመርኩዞ በቀለኛውና ጨካኙ መንግስት የነገው ህይወታቸውን እንደሚያጨልመው እና በነዛ ቀጫጭን እጆቻቸው ላይ ያጠለቀውን ካቴና የበለጠ እንደሚያጠብቀው ቢረዱም። የታሰርነው፡ እኛ እንጂ እነሱማ ነጻ ናቸው።  
ርዕሱን  አላስታውሰውም ‘ንጂ እ.ኤ.አ በ2011 Arab Uprising በመባል የሚታወሰውን አብዮትተከትሎ፣ ኢትዮጵያውያን ፌስቡከኞችም (በተለይ ዲያስፖራ የሚገኙ) ግንቦት 20 ላይ (ልክ በኢሕአዴግ የ20ኛ አገዛዝ ዕድሜ)   “Anger day” በሚል በፌስቡክ አብዮትመጥራታቸውን ተቃውሜ አንዲት ጽሑፍ ጽፌ ነበር፡፡ በዓመቱ ደግሞ ‹‹ አብዮት ወረት ነው›› በሚል ርዕስ በፌስቡክ አብዮት ለማስነሳት ፍላጎት ያላቸው በርካቶች እንዳሉ ገልጬ ነገር ግን ይጎድላቸዋል የሚባሉትንነገሮች ዘርዝሬ ጽፌ ነበር፡፡ በነዚህ ሁለት ጽሑፎች ላይ፣ ላዩን አብዮትን የተቃወምኩ ቢመስልም እውነታው ግን ጽሑፎቹ በተጻፉበትወቅት ሕዝቡም፣ ተቃዋሚ ልሂቃኑም፣ ሁኔታዎቹም ለአብዮት ዝግጁ አይደሉም የሚል ዝንባሌ ማሳየቱ ነበር፡፡

ከሌላ ዓመት በኋላደግሞ ‹‹ስለለውጥ›› በሚል ርዕስ ተከታታይ ጽሑፎችን በ‹‹ዞን 9›› ላይ በግል ተነሳሽነት ማስፈር ጀምሬ ነበር፡፡ ጽሑፉን የጀመርኩት ‹‹ኢሕአዴግ ሥልጣኑን በምርጫ ይለቃል?›› በሚል ጥያቄ ነበር፡፡ ‹‹አይለቅም›› የምልባቸውን ምክንያቶች ካስቀመጥኩ በኋላ የለውጥ አማራጭ የምላቸውን (አብዮት፣ሰላማዊ አለመታዘዝ /civil disobedience/ የመሳሰሉትን) በየዘርፉ እየቀነጫጨብኩ ለማሳየት ነበር ዓላማዬ ከዚያም ‹‹የለውጥ ፍርሃት››፣ ‹‹የሥርዓት ለውጥ እና ሃይማኖት››፣ ‹‹የ1966ቱ የኢትዮጵያ አብዮት እና የማኅበራት ሚና›› የሚሉ ርዕሶችን በማንሳት በሐሳቦቹ ላይ በሐቀኝነት ለመከራከር ጥረት አድርጌያለሁ (ከዚህ በላይ አልገፋሁበትም እንጂ)፡፡ በበኩሌ ስለአብዮት በደንብ ያነበብኩትም፣ ያሰብኩትም፣ የጻፍኩትም፣ የተረዳሁትም ያኔ ነበር፡፡ ያኔ በአብዮት ላይ የነበረኝ እምነት ተሸርሽሮ ግማሽ ደርሶ ነበር፡፡ ተንጠፍጥፎ ያለቀው ግን

First of all I'd like to thank Mahilet Solomon, for her tremendous job in translating this leaked letter by one of the members of Zone 9 bloggers aka Befeqadu Hailu, just a day after it was published. It shows not only her translation skill but also her unparalleled devotion to the freedom of expression, and above all her care for thousands of fellow Ethiopians who are being incarcerated for the crimes they didn't commit. Befqadu also should be commended for penning this very troubling and obvious account under such brutal circumstances where he, other members of Zone 9 bloggers, journalists, opposition party leaders and their followers have to go through everyday and night in present day Ethiopia. What Befqadu wrote is not something new, however it helps to open our eyes about the alarming situation with regard to the human-rights abuses in Ethiopia especially against those under police custody. The Ethiopian government denied and is still denying all these allegations, even though firsthand experiences by the likes of Befqadu and research documents by other human-rights watchdogs reveal these broad-light gross abuses against innocent and unarmed Ethiopians who did nothing but exercised their constitutional and birthrights. I hope, one day all the culprits of these heinous crimes will be brought to justice and eventually innocent victims of this brutal system will be freed. "So what do you think is your crime?" I was asked by one of my interrogators while I was telling him about what I did as a blogger, an advocate and an activist. Later on, after I was allowed to meet with my "collaborators" according to my prisoners and asked each other, we found out we were all asked this same question “what do you think is your crime”? This describes the overall outcome of our interrogation. Since they couldn’t figure out what our supposed crime was or what law we were suspected of violating, we were asked

‹‹አያ ጅቦ ሳታመኻኝ ብላኝ›› በጦማሪው በፍቃዱ ሃይሉ ተጽፎ ከቂሊንጦ እስርቤት ሾልኮ የወጣ ጽሁፍ

Cases of Zone9 Bloggers & Journalists referred to the Court in the Absence of both the Defendants & their Lawyer

The first instance court of Arada bench was expected to wrap up the pre-trial ‘hearing’ which took more than 70 days and yet the bloggers were not even brought before the judge. Mr.Amaha Mekonnen, a lawyer defending the bloggers & journalists who are detained on unclear but shaping up to be on terrorism charges expected the first instance court at Arada bench to rest the pre-trial procedure last Saturday. The court had set the 12th July hearing for closing arguments but with an extraordinary move the police referred the case to the Federal High Court without even the presence of neither the defendants nor their defense lawyer himself. The shift overlooked the court and contravenes even the standard procedure of the biased justice system. The lawyer speaks to Dawit Solomon, a journalist based in Addis Ababa about the issue. Here are the translated excerpts from the interview.

DAWIT: What were your thoughts on your way to the court for Saturday’s procedure?

AMAHA: I expected the police might demand for more time to wrap up their interrogation as usual. I also sought to see how the court would reply to this repeated claim of the police. Nevertheless, to the shock of me and all people who were here what unfolded was really baffling. Since the detainees were not brought to the court some journalists went straight to the court’s registrar to ask about the case. Then a person who claimed himself as “the detective” of the case told the journalists since he is done with the interrogation he submitted the case for a prosecutor. He further claimed that the case is closed. This was what I was told by the journalists then I also went in to verify which I found it true. They closed the case without the presence of neither my clients nor me who is representing them.

DAWIT: What action have you taken after you heard?

AMAHA: We have been to court’s compound way earlier than the scheduled time of the hearing. When the detectives/police officers presented their arguments it should be in our presence. I have tried to explain our disappointment to the judge. This is basically a grave breach of law.

DAWIT: So what is the encroachment? Where is the breach of the law?

ሁለት ወር ከሃይ ቀናት በእስር ያሳለፉት ስድስቱ ጦማርያን እና ሶስቱ ጋዜጠኞች በሶስት የጊዜ ቀጠሮ መዝገብ፡በሰንበት ሲመላለሱ ከርመው ትናንት ቅዳሜ በሌሉበት መዝገቡ ለዓቃቤ ህግ መተላለፉን በቦታው ተገኝታ የነበረችው ጋዜጠኛ ጽዮን ግርማ ዘገበች። ሃምሌ ዓምስት ተቀጥረው የነበሩት ጋዜጠኞች ተስፋለም፡ወልደየስ፡ አስማማው ኃይለጊዮርጊስ፡ኤዶም፡ካሳዬ እና የህግ መምህር እና የዞን ዘጠኝ ጦማሪ ዘልዓለም ክብረት፡ እንዲሁም የዞን ዘጠኝ ጦማርያን ናትናኤል ፈለቀና አጥናፉ ብርሃነ፡በአጠቃላይ ስድስቱ ተጠርጣሪዎች ፍርድቤት ይቀርባሉ ተብሎ እስከ ጠዋቱ አምስት ሰዓት ተኩል ድረስ ሲጠብቅ የነበረው ችሎት ተከታታይ በመጨረሻም ችሎቱ ማብቃቱ ተነግሮታል። ቆይታው ግራ ያጋባቸው፡ጠበቃው አቶ አመሃ መኮንን ሁኔታውን ለማጣራት ችሎት፡ገብተው ሲጠይቁ፡ "ውይ አለቀኮ"፡ የሚል ምላሽ ተሰጥቷቸዋል። "እዚህ ውጭ ቁጭ ብለን እየጠበቅን እንዴት ነው አለቀ የሚባለው"፡ ብለው ላነሱት ጥያቄም "ስንጠራችሁ፡ አልሰማችሁም፡ የሚል ምላሽ ተሰጥቷቸዋል"። "ግቢ፡ውስጥ ከሶስት መቶ ሰው በላይ ተቀምጦ የእነርሱን ጉዳይ እየጠበቀ፡ጠበቃቸው እዚህ እያለ እንዴት፡አልሰማችሁም ይባላል" ብለው ቢጠይቁም ጠበቃ አይስፈልጋችውም ነበር። የሚል ምላሽ ተሰጥቷቸዋል። "ተጠርጣሪዎቹስ መች ቀረቡ?" ብለው ሲጠይቁም "እነርሱ አይስፈልጉም ነበር፡ ፖሊስ ይህን መዝገብ ዘግቼ፡ጉዳዩን ለዓቃቤ ህግ፡ አስተላልፊያለሁ አለ። በዛ መሰረት መዝገቡ ተዘጋ" በማለት ምላሽ ሰጡት።

የጦማሪው ማስታወሻ ለ78 ቀናት እና ማእልታት ምንም ዓይነት ክስ ሳይመሰርትባቸው የጓንታናሞ ታናሽ በሆነው ማእከላዊ እስርቤት የሚንገላቱት የኢትዮጵያ ተስፋዎች፡ ህይወት ላይ የምትጫወቱ ዳኛ፡ፓሊስና አቃቤህግ ተብዬዎች፡ታሪክ ፍርዱን ይሰጣችኋል። የትናንትናው የዞን9 ጦማርያን እና ጋዜጠኞች ጉዳይ የፍርድቤት ውሎ ኢትዮጵያ ውስጥ አለ የሚባለው የህግ ስርዓት፡ ለእነማን እና በእነማን ጠለላ ስር እንድሆነ ለ101ኛ ጊዜ ፍንትው ብሎ ያሳያል። እነ ጠቅላይ ምኒስትር  ደሳላኝ ሃይለማርያም  አለ የሚሉን ህግ ተርጓሚ እና አስፈጻሚ ሚና እንዲህ ተደበላልቆ ትርጉም ያጣበት ጊዜ ላይ መድረሳችን፡ የዚህች አገር እጣ ፈንታ ከድጡ ወደማጡ   እያዘገመ  መሆኑን :ጥሩ አመላካች ነው።

ጋዜጠኛ ጽዮን ግርማ በአራዳ ምድብ ችሎት በአካል በመገኘት እንደዘገበችው እንደዘገበችው  በዛሬው እለት የተከናወነው   የፍርድ  ቤት ድራማ ያው ህውሃት እንደለመደው በፍቃዱ ሃይሉ ማህሌት ፋንታሁን እና አቤል ዋበላ ላይ ፖሊስ ከትላንትናው ጋር ተመሳሳይ የሆነ የ28 ቀን ጊዜ ቀጠሮ የጠየቀ ቢሆንም ፍርድ ቤቱ 14 ቀን ፈቅዶለታል፡፡ፖሊስ የጸረ ሽብር አዋጁን በመጥቀስ በሽብር ክስ ለማቅረብ ስላሰበ 28 ቀን እንዲሰጠው የጠየቀ ቢሆንም ዳኛው ያለምንም የተለየ ተጨማሪ ነገር ከመነሻ ጥርጣሬ ለመቀየር ፖሊስ አሳማኝ ምክንያት ባለማቅረቡ 14 ቀን ተጨማሪ የምርመራ ጊዜ ብቻ ፈቅደዋል። የዛሬውን ውሎ ለየት የሚያደርገው፡ ፖሊስ የታሳሪዎቹ ቤተሰቦች እና ወዳጆችን እንዳያለቅሱ፡ለታሳሪዎቹ እጃቸውን 

እንዳያውለበልቡ እና ምንም ዓይነት ምስል በፍርድቤቱ ቅጥር ግቢ ውስጥ እንዳያነሱ/እንዳይቀርጹ መከልከሉ የአፈናውን 

መጠነሰፊነት ያሳያል። ይህንን ጉዳይ በተመለከተ በትዊተር ላይ ዜጎች በሚከተለው መልኩ ቁጣቸው እና ሮሮአቸውን ሲገልጹ ነበር።

የዞን 9 ጦማርያንን የጊዜ ቀጠሮ ሊያይ በተሰየመው ችሎት ዛሬ ሌላ አሰቃቂ ዜና አብሮ ሰምቷል፡፡ ሁለቱ የዞን9 አባላት በፍቃዱ ሃይሉና አቤል ዋበላ በማእከላዊ እስርቤት ፖሊሶች መመታታቸውን እና ውስጥ እግራቸው ላይ ግርፋት እንደተፈጸመባቸው የገለጹ ሲሆን ፓሊስ ማስረጃ የላቸውም ሲል ተከራክሯል፡፡ ለክርክሩ ምላሽም ውስጥ እግራቸውን ለፍርድ ቤቱ ማሳየት እንደሚችሉ ተናግረዋል፡፡ ፍርድ ቤቱ ቶርቸር ህግ መንግስታዊ አይደለም ሲል "አስተያየቱን" ሰጥቷል፡፡ እንደትላንትናው ሁሉ በተመሳሳይ ምክንያቶች የተነሳ ተጨማሪ የጊዜ ቀጠሮ የተጠየቀባቸው ሲሆን ፍርድ ቤቱ ተጨማሪ 10 ቀናትን ለምርመራ ፈቅዷል፡፡

በዛሬው የፍርድ ቤት ውሎ ለተከሳሾቹ ጭብጨባ እና ፉጨት ማሰማት የተከለከለ ሲሆን ተከሳሾች ሲወጡ ባሳዩት አጋርነትም ከዛሬ በኋላ ካጨበጨባችሁ እንዳትገቡ እናደርጋለን የሚል ማስፈራሪያም ተሰጥቷል፡፡ ወ/ ሮ ስንታየሁ የተባሉ የሬጅስትራር ሰራተኛ ጭብጨባውን እና ፉጨቱን ለዳኛ በመንገር (በተለመደ ቋንቋ በማቃጠር) አጋርነት እያሳዩ የነበሩትን ወጣቶች ተግባር ለማስቆም ሞክረዋል፡፡

በድጋሚ የዞን 9 አባላት  የወሰዷቸው ምንም አይነት የአሸባሪነት ስልጠና እንደሌለ እያረጋገጡ በህገ መነግስቱ አንቀጽ 18 መሰረት ማንኛውም ሰው ጭካኔ የተሞላበት ኢሰብአዊ  በሆነ መንገድ ክብሩን ከሚያዋርድ አያያዝ ወይም ቅጣት የመጠበቅ መብት አለው ቢልም በታሰሩ አባላቶቻችን ላይ የደረሰውን ግርፋት አጥብቆ ያወግዛል፡፡

Attention: JUSTICE has been crucified for Nth times in Ethiopia's capital Addis Ababa early this afternoon by TPLF, accusing the most priceless next generation of activists who have no other political, economical or other agenda other than being a voice to millions of voiceless Ethiopians. Ethiopia file Charges against #FreeZone9Bloggers, Journalists detained over the Weekend

Charges were brought against a group of bloggers writing for Zone9 and three journalists detained by security forces on Friday April 25^th and Saturday April 26^th.  

Friends of the detainees were told this morning at the Ma’ekelawi, the central investigation office where the detainees were are kept since Friday that charges were already filed against the detainees on Sunday April 27^th. According to journalist Lily Yekoye,

The Ethiopian government has arrested six independent bloggers and a journalist in what human rights group Amnesty International has called a "suffocating grip on freedom of expression".

Six members of independent blogger and activist group ‘Zone 9’ and a prominent Ethiopian journalist were arrested on Friday in the capital Addis Ababa.

All six bloggers were arrested at night by armed security forces and taken from their homes to the Federal Police Crime Investigation Sector ‘Maikelawi’, where political prisoners are alleged to be held in pre-trial, and sometimes arbitrary detention.

Ethiopian Journalists Accused For Investigating Adoption Scandal

Firew Abebe the editor-in-chief of Sendek ( one of the few renaming dissident and critical newspapers in the country ) told AddisAdmass, a local Amharic weekly that he appeared at the Makelawi Police Investigation Prison last Thursday accused of defamation following publishing an investigative report about adoption malpractices in Ethiopia. The case was filed against the editor by Ethiopia's Women, Youth & Children Ministry. 

According to Firew, his paper published an Editorial under the title "The Campaign Against Adoption Should Start with Accountability" and OP-ed entitled Adoption & the loopholes in our Legal System on its legal column. 

Some of the funny accusations filed by the Ministry includes among others: damaging the country's image, eroding the credibility of the legal system and defamation against the Minister in charge. 

Firew added the accusation was meant to threaten his paper from exposing the rampant rent seeking and corruption in Ethiopia and vowed to make every sacrifices the profession demands to get the job done.
